Virginia courts determine custody based on one primary standard: The Best Interests of the Child. The court looks at many factors, including the age of the child, the relationship with each parent, and each parent's ability to resolve disputes.
There are two distinct types of custody we will address:
• Legal Custody: The authority to make major life decisions regarding your child's education, healthcare, and religious upbringing. (Joint legal custody is most common).
• Physical Custody: Where the child lives on a day-to-day basis and how parenting time (visitation) is scheduled.
Both parents have a legal obligation to financially support their children. In Virginia, child support is calculated using a strict formula that factors in both parents' gross incomes, the cost of daycare, health insurance premiums, and the number of days the child spends with each parent. I ensure all income is accurately reported and that the final calculation is fair and sustainable.
